Global Offshore Contacts Pty Ltd (ACN 127 094 286) (‘we’, ‘our’, ’us’) is not bound by the Privacy Act 1988 (Cth) as it is a small business operator within the meaning of the Act and falls within the small business operator exemption.  Despite this, our information handling policies and practices are informed by the National Privacy Principles (‘NPPs’) under the Privacy Act 1988 (Cth). We are committed to ensuring the privacy of the information of users of the Global Offshore Contacts Websites (“Website”), including employers, employees and organisations that register as members of the Website (“Members”). We understand that your personal information, and how we use it, is very important to you. 

    2. This statement reflects our policy in relation to the collection and handling of your personal information by us.

    3. By using the Website, you consent to the terms of this privacy policy and the collection, use and disclosure of your personal information described in this policy. If you do not agree with any term of this policy or do not consent to the collection, use and disclosure of your personal information described in this policy, please do not use the Website. Users are advised that there are inherent risks in transmitting information across the internet.

    1. Types of Personal Information Collected by us

      1. Personal information is any information or an opinion (whether true or not) about you. Personal information may include sensitive information (for example, religious beliefs, health status, ethnic origins, and membership of a union or professional association).

      2. Personal information that we collect and hold usually falls into the following categories:

        1. personal information submitted by or obtained from each Member or persons that use the facilities or services available on the Website;

        2. personal information provided by Members (such as name, contact details, resumes etc) when Members register as members of the Website; and

        3. in respect of Members who are seeking employment using the Website, information that they place in job application or resumes, for example, name, mailing address, telephone number, e-mail address, career history, details of any competency tests or other information relating to the applicants career.

    2. When do we collect personal information?

      1. We will not collect personal information unless we consider it necessary for the functions, facilities and activities of the Website and the services made available to Members through the Website.

      2. Situations in which we may collect personal information include

        1. when you register as a member, either as an employee, an employer or an oil and gas organisation;

        2. when you set up a “Member Profile” on the Website;

        3. when you apply for a job which is advertised on the Website;

        4. when Members or other users of the Website subscribe to a mailing list;

        5. when you access the Website and use any of its facilities and functions;

        6. when required by law; and

        7. when dealing with certain government agencies.

    3. Ways in which we collect personal information

      We collect personal information through the Website and through other methods of communication. As described above, most of the personal information that we collect is provided to us by Members and other users of the Website when accessing the functions, facilities and activities of the Website and the services made available through the Website.

    4. What do we use personal information for?

      We use personal information to enable Members and other users of the Website to make use of the facilities and functions available to them on the Website, including (but not limited to):

      1. facilitating recruitment or placement of employees or contractors;

      2. facilitating job seeking efforts of Members;

      3. providing advertising and marketing opportunities for Members; and

      4. providing an online forum for Members to communicate with each other.

    5. Information collected about the Websites users

      1. We gather information about the Website’s users collectively, such as what areas users visit more frequently and what services users access the most. We only use such data anonymously and in the aggregate. This information helps us determine what is most beneficial for Members and other users of the Website, to assist in the diagnosis of problems and to provide support to the Websites users.

      2. The Website uses "cookies" (small computer files that a website can store on the computer you are using to store information you have provided) to make the Website easier to use by storing information about your preferences or data you have entered at the Website. Initially most internet browsers are set to accept cookies. You can adjust your browser so that cookies are not stored on the computer you are using or to warn you when cookies are being used, however, this may affect the operation of the Website.

  3. Disclosure and use of personal information

    1. Disclosure and use

      We will not use or disclose personal information about an individual for a purpose other than:

      1. the purpose for which it was collected;

      2. a related purpose which the individual would reasonably expect;

      3. a purpose required or permitted by law; or

      4. a purpose for which we have obtained the consent of the individual.

    2. When do we collect personal information?

      1. We may disclose your personal information to:

        1. Members and users of the Website;

        2. potential and actual employers who are Members of the Website;

        3. our contractors, advisors and suppliers which we engage in connection with the Website, such as IT consultants and database designers; and

        4. any person with a lawful entitlement to obtain the information.

      2. We may also be required to disclose your personal information to some third parties by law.

      3. We may provide you with certain information in relation to the Website and its facilities and functions by use of email. These emails will be sent to Members of the Website and will provide Members with the option of opting out of receiving these emails.

  4. Accuracy of personal information

    1. Accuracy

      We will take all reasonable steps to make sure that the personal information we collect, use or disclose is accurate and up to date.

    2. What to do if you believe the information we hold about you is inaccurate

      If you believe that any information that we hold about you is inaccurate or out of date, please contact us and we will review and update the relevant information.  You may modify or delete your “member’s profile” at any time by accessing the Member Intranet, logging in to your profile.

  5. Storage of personal information

    1. We will take all reasonable steps to protect and safeguard the personal information we collect and hold from loss, unauthorised access, and misuse.

    2. Your personal information may be stored in hard copy documents, or electronically on our software or systems.

    3. When no longer required, personal information is destroyed in a secure manner or deleted.

  6. Access to your personal information

    1. Access

      1. If you request, then in most circumstances we will make available to you the personal information about you that we hold, except where we are required or entitled by law to refuse access. Situations where we might not allow you access to your personal information are described below.

      2. Requests for access to your personal information should be made in writing to our privacy officer.

      3. We will respond to a request for access to information as a priority and will endeavour to do so within a maximum of 10 days.

    2. When might we refuse access to your personal information?

      1. In certain circumstances we may refuse you access to your personal information.

      2. The circumstances in which we might do so include:

        1. it would have an unreasonable impact on the privacy of others;

        2. the information relates to legal proceedings with you;

        3. the information would reveal our commercially sensitive decision-making process;

        4. providing access to the information would prejudice certain investigations;

        5. we are required by law not to disclose the information

  7. Transborder data flows

    Sometimes, we transfer information to person outside Australia. By giving us your personal information, you consent to such disclosures.

  8. Website links and use of information by others

    1. Through the Website:

      1. personal information is made available to Members; and

      2. we provide links to third party sites which may collect your personal information.

    2. The collection, use and disclosure of your information by these parties is subject to the information handling practices of the third parties, is not within the control of us and we do not accept responsibility for the privacy policies and information handling practices of any third parties. You should consult the privacy policies of these parties.

  9. Change in our privacy policy

    We will review and change this privacy policy from time to time and will inform you of any changes to this policy.

    We want to improve our systems and procedures to give you full confidence in our ability to respect and safeguard the privacy of the personal information you provide to us. If we have not fulfilled our commitment to you, please tell us by contacting our privacy officer.
